No blame, no claim

Not at fault and able to prove it? You won’t lose any claim-free years

It doesn’t bear thinking about: a child suddenly runs into the street in front of you. You brake as hard as you can, but you’re unable to avoid an accident. The child is left with a sprained ankle. Not your fault, wouldn’t you think?

The law protects pedestrians and cyclists

The Dutch Road Traffic Act states that a motorist is always liable in the event of a collision with a pedestrian and has to cover at least 50% of the pedestrian’s claim, even if there was no way you could have avoided the accident. This is because the law protects vulnerable road users such as cyclists and pedestrians. The good news is that you have car insurance and that we will cover the claim.

Claim paid, no consequences for you

Normally, claims affect your claim-free years and, therefore, your no-claims bonus. However, if you can prove that the accident was not your fault, your claim-free years will not be reduced. This is what we call ‘No blame, no claim’. You will keep the same number of claim-free years and the (no-claim) discount on your premium will not change.

There are more types of claims that won’t affect your claim-free years

In the following cases, a claim involving your car will not affect your claim-free years:

  • Theft and break-ins
  • Damage caused by fire, storm and nature
  • Windscreen damage
  • Damage caused by transporting an injured person
  • Damage that can be claimed back from someone else
  • Personal injury or damage to property of a pedestrian or cyclist if you can prove it was not your fault

No-claims bonus reinstated if you pay back the claim

Your claim-free years and no-claims bonus will also be reinstated if you pay us back a claim that has affected your claim-free years. This is on the condition that you pay back the claim within 24 months after it was paid.
